- Several bystander videos went viral on Sunday evening depicting the fatal shooting of an Emmerentia man.
- He was shot and killed following an alleged road rage incident.
- The National Prosecuting Authority said there was insufficient evidence to prosecute.
The National Prosecuting Authority (NPA) will not be proceeding with charges against the shooter, 58, involved in the Emmarentia road rage incident in Johannesburg that left one man dead and his wife hospitalised with injuries.
NPA spokesperson Magaboke Mohlatlole told reporters this outside the Johannesburg Magistrate’s Court on Tuesday, where the man was set to appear after a four-hour delay.
“After the full consideration of the evidence of the alleged road rage incident, the NPA has decided not to proceed with the matter pending further investigations.”
On Sunday, videos circulated of a man who had been shot in front of his two young children – aged eight and 10 – in what was believed to be a road rage incident following a collision in Emmarentia.

The SA Police Service later arrested the man on charges of murder and attempted murder.
Several bystander videos show both drivers exiting their vehicles and engaging in a heated verbal dispute on the sidewalk that lasts several minutes after an apparent bumper bash.
According to a police statement, the wife of the deceased victim allegedly retrieved a firearm from their vehicle, prompting the second driver to draw his own weapon.
A witness who spoke to News24 said the wife fired shots into the air.
Shots being fired are heard in the bystander videos.
The 58-year-old man then draws his firearm and discharges multiple rounds at close range. The victim collapses instantly, and his wife is seen being struck by gunfire as she attempts to intervene.
