This after a document which was filed on time on central online legal document platform CaseLines came through late due to an administrative error, according to Judge Leonard Twala.
A step to load the document onto the platform, where the judge could have sight of it, was not done until last night.
Malema’s team will pay Kunene’s legal team’s costs.
In the meantime, the team will reinstate the matter pending Malema's instructions.
Malema wants Kunene to pay him damages for defamation in connection with the PA deputy president’s claim on a MacG podcast in February this year that he was linked to a “Big Five” drug cartel.
